Motor City Hockey Registration Agreement
This Registration Agreement ("Agreement") is a binding contract between Motor City Hockey ("Motor City Hockey," "we," "us") and the parent or legal guardian completing this registration ("you," the "Registrant"), for yourself and for each player you register ("the player"). Please read all of it. By checking each box, typing your full legal name and drawing your signature, you accept every term below.
1. Who is signing
You confirm that you are at least 18 years old and that you are the player's parent or legal guardian (or the adult participant), with full authority to sign this Agreement for yourself and for each player you register. You sign this Agreement electronically. Your electronic signature has the same legal effect as a handwritten signature under the Michigan Uniform Electronic Transactions Act (MCL 450.831 et seq.) and the federal E-SIGN Act (15 U.S.C. 7001 et seq.).
2. You are reserving exact dates and times
You are registering for the exact program, time slot and dates listed on your order and receipt, nothing more. Your spot is held for you alone and is blocked from every other player the moment you register. Ice, coaches and facilities are booked and paid for in advance based on your commitment, whether or not your player attends.
3. ALL IN Policy: all registrations are final
- If you are not 100% committed, do not sign up.
- No refunds. No credits. No make-ups. This applies to missed skates for any reason, including illness, injury, schedules, weather, team conflicts, removal for conduct, or a change of mind. No situation is exempt.
- Registrations are non-transferable to another player, program, date or time.
- Your payment covers only the exact dates and times you registered for.
- The only exception: if Motor City Hockey or the rink cancels a skate, you receive a credit for that date toward a future Motor City Hockey program. Credits have no cash value.
4. Price and pro-rating
Season programs are priced per skate date. If you register after a season has started, the price is reduced automatically by the per-date amount for every date already played, so you pay only for the dates left. The price shown at checkout is the price you owe.
5. You are personally responsible for the full amount
- By signing, you personally guarantee and agree to pay the full amount of every registration in this order, including every deposit, scheduled payment and balance shown at checkout. This obligation is yours, as the adult who signed, whether or not the player attends, and whether or not another person (a spouse, co-parent, team or sponsor) agreed to pay part of it.
- If you chose a payment plan, you authorize Motor City Hockey to charge your saved card automatically on each scheduled date until the balance is paid in full.
- Stopping payment, cancelling or changing your card, a declined payment, or not paying a scheduled payment does not cancel what you owe. If any scheduled payment is not paid within 10 days after its due date, the entire remaining balance of the registration becomes due immediately.
- If a payment is returned or declined, you also owe a returned-payment fee of $25 or the maximum amount allowed by Michigan law, whichever is less.
6. Chargebacks and payment disputes
You agree not to dispute or charge back a valid charge under this Agreement with your bank or card company. A chargeback or dispute of a valid charge is a breach of this Agreement. It does not cancel your debt: the full amount stays owed, together with every dispute fee and cost Motor City Hockey is charged, and Motor City Hockey may submit this signed Agreement and your registration record to the bank as proof. Until the balance is paid in full, the player may be suspended from all Motor City Hockey programs.
7. Unpaid balances: notices, then small claims court
Motor City Hockey is a small business that pays the cost of ice, coaching and facilities up front. One unpaid registration takes a spot another player could have had. We pursue every unpaid balance.
- First notice: we email you the amount past due and a date to pay it by.
- Second and final notice: if it is still unpaid, we email you a final notice stating that the account will be filed in Small Claims Court if not paid by the date given.
- If it is still unpaid after the final notice, we may file a claim against you in the Small Claims Division of the District Court in Oakland County, Michigan, or refer the account to a collection agency or attorney, without further notice.
Notices are sent to the email address on your registration, and a notice sent there counts as notice to you. It is your responsibility to keep that email address current and to read it.
8. You pay all costs of collection
If you do not pay any amount when it is due, you agree to pay, in addition to the balance itself, every cost Motor City Hockey incurs to collect it, to the fullest extent permitted by Michigan law, including:
- small claims and other court filing fees, and the cost of preparing and filing the claim;
- fees to serve the claim or any court papers on you;
- court costs, and the costs of enforcing any judgment (such as garnishment, writs and filing fees);
- collection agency fees and charges;
- reasonable attorney fees, if the account is handled by an attorney or the matter is heard outside the small claims division;
- bank, card and dispute fees charged to Motor City Hockey; and
- interest on the unpaid balance from its due date until paid, at the maximum rate permitted by Michigan law, not to exceed 7% per year.
9. Assumption of risk
Ice hockey and skating are physical, high-speed contact activities. Injuries can and do happen, including cuts, broken bones, concussions, serious injury, permanent disability and, rarely, death. They can be caused by falls, collisions, sticks, pucks, boards, equipment, the ice surface, other players, or the actions of coaches and staff. You understand these risks, you accept them for yourself and for the player, and you confirm the player is physically able to take part. The player must wear full, properly fitted protective equipment, including a certified helmet with a full face mask, at every on-ice session.
10. Release of liability
To the fullest extent Michigan law allows, you release, waive and agree not to sue Motor City Hockey, Viva La Hockey LLC, their owners, coaches, staff, volunteers, and the rinks and facilities used ("the Released Parties") for any claim, injury, loss or damage you may have that arises from the player's participation, including claims based on the Released Parties' ordinary negligence. To the fullest extent the law allows, you also agree to indemnify the Released Parties against claims brought on the player's behalf. This release does not cover gross negligence or willful misconduct.
11. Medical treatment
If the player is hurt or ill and you cannot be reached right away, you authorize Motor City Hockey staff to get emergency medical care for the player. You are responsible for all medical costs. You confirm the medical information you provided is complete and accurate.
12. Photo, video and social media release
Motor City Hockey regularly takes photos and video at skates, camps and events. You grant Motor City Hockey permission to photograph and record the player and to use those photos, video, and the player's first name and team or program on our website, social media (such as Instagram, Facebook and YouTube), advertising and promotional materials, without payment or approval of the final use. We never publish a player's home address, school, or contact information. You may stop future use by emailing team@motorcityhockey.com; material already published or printed does not have to be removed.
13. Conduct and safety
Players and families must follow coaches' and rink rules. Motor City Hockey may remove a player from a session or program for unsafe or disrespectful behavior, without a refund or credit.
14. Michigan law, court and venue
This Agreement is governed by the laws of the State of Michigan. Any claim or collection action arising from this Agreement will be brought in the courts located in Oakland County, Michigan, including the Small Claims Division of the District Court, and you consent to the jurisdiction of those courts.
15. Entire agreement, severability and future registrations
This Agreement, the program description and the participation waiver are the entire agreement about this registration; no verbal promise changes it. If any part is found unenforceable, it will be enforced to the fullest extent allowed and the rest stays in full effect. This Agreement applies to every registration you make with this account until replaced by a newer version you sign. A copy of this signed Agreement is emailed to you.
By signing, you confirm that you are 18 or older and the player's parent or legal guardian (or the adult participant), that you have read and understand this entire Agreement, and that you agree to all of it, including the ALL IN Policy (Section 3), your personal responsibility for the full amount (Section 5), and payment of all collection costs, small claims and court costs, and attorney fees (Sections 7 and 8).
